TELADOFT, Illinois—A $5 million lawsuit, filed today in the U. S. District Court for the Northern District of Illinois against Pfizer, the maker of the popular erectile dysfunction medication Viagra, alleged that the company failed to warn consumers about the risks associated with buying Viagra or similar drugs, according to a federal court filing. The lawsuit, filed in New Jersey federal court on Nov. 8, is seeking a declaratory judgment that the drug companies failed to adequately warn consumers about the risks, or failure to properly inform consumers about the dangers, associated with such drugs.
The case has been pending in the Northern District of Illinois for more than a year and was filed in federal court in the Eastern District of New York, where the lawsuit was filed.
Viagra, marketed by Eli Lilly and Company, is among the most commonly prescribed drugs for the treatment of erectile dysfunction. The drug is a member of the PDE5 inhibitor class of medications.
The lawsuit alleged that the company failed to adequately warn consumers of the risks, or failure to properly inform consumers about the dangers, associated with such drugs. The plaintiff, John D. Dolin, MD, of Fort Lauderdale, Fla., was a board-certified pediatric urologist at Northwestern Memorial Hospital and at the University of Chicago, and represented him at the case.
Dolin has received numerous awards for his contributions to the field of urology and is a past president of the American Urological Association.
In addition to the lawsuit, Dolin has served on the board of the American Urological Association, and has been a prominent member of the board of directors of the National Urological Association, a trade association of urological doctors, in the United States, Canada, and Australia.
The suit was filed on behalf of John Dolin, also of Fort Lauderdale, Florida, and his son, Matthew Dolin, of Fort Lauderdale, Florida, who was born in February 2009, and was admitted to Fort Lauderdale, Florida.
The lawsuit was filed in federal court in the Eastern District of New York in the Eastern District of Illinois, where the suit was filed.
